Where a private driveway leading from private property to, and connecting with, any public street in the town, crosses and passes over and above a gutter or drainage ditch along the side of such street, the owner of the property from which such private driveway leads, shall, at his own cost and expense, install and construct under the driveway where the same crosses and passes over and above such street gutter or drainage ditch, a culvert which, in the opinion of the city engineer, will be of adequate capacity to carry the water which flows therein during the winter season.
