In addition to all regulations set forth by the FAA and/or state law, the following shall apply to the operation of any model aircraft within the town of Atherton:

A. No person shall operate any model aircraft within five miles of an airport without prior notification of the airport air traffic control tower identifying the location where the model aircraft will be operated.

B. No person shall operate any model aircraft in a way that interferes with manned aircraft and shall always give way to any manned aircraft.

C. No person shall operate any model aircraft beyond the visual line of sight.

D. No person shall operate any model aircraft other than during daylight hours, defined as between official sunrise and official sunset for local time.

E. No person shall operate any model aircraft more than four hundred feet above the earth’s surface at the location where the aircraft is operated.

F. No person shall operate any model aircraft closer than twenty-five feet to any individual, except for during takeoff and landing.

G. No person shall operate any model aircraft to which is attached any device capable of receiving, recording and/or transmitting visual images or sound, including but not limited to any still or video camera. (Ord. 623 (part), 2017)
